Intellectual Property Rights and Copyright Infringement Notification

GoNsayn respects the intellectual property rights of others and we expect that you please have the same respect for others.

In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website at www.copyright.gov/legislation/dmca.pdf, GoNsayn will quickly respond to claims of copyright infringement committed using any of the Site’s services that are reported to GoNsayn’s Copyright Infringement Agent.
What is copyright? Copyright is a form of protection provided for original works of authorship, including literary, dramatic, musical, graphic and audiovisual creations. "Copyright" literally means the right to copy, but has come to mean that body of exclusive rights granted by law to copyright owners for protection of their work.
What is copyright infringement? Copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner.
Posting copyright-infringing content can lead to the termination of your account and profile, and possibly monetary damages if a copyright owner decides to take legal action against you and sue you for monetary damages or otherwise. Below are some guidelines to help you determine whether your articles, literary contributions, videos, and/or any other form of display is eligible or whether it infringes someone else's copyright.

Copyright Infringement Notification

To file a copyright infringement notification with us, you will need to send a written communication that includes substantially the following (please consult your legal counsel and/or attorneys before doing so) also, see Section 512(c)(3) of the Digital Millennium Copyright Act to confirm these requirements:

  1. 1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. 2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. 3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.
  4. 4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. 5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. 6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification

Counter Notices

The process for counter-notifications is governed by Section 512(g) of the Digital Millennium Copyright Act: http://www.copyright.gov/legislation/dmca.pdf.
One who has posted material that allegedly infringes a copyright may send us a counter notice pursuant to Sections 512(g)(2) and 512(g)(3) of the DMCA. When GoNsayn receives a counter notice, we may in our discretion reinstate the material in question in not less than 10 nor more than 14 days after we receive the counter notice unless we first receive notice from the copyright claimant that they have filed a legal action to restrain the allegedly infringing activity. To provide a counter notice to us, please return the following form to GoNsayn’s Copyright Agent. Please note that if you provide a counter notice, in accordance with the GoNsayn’s Privacy Policy and the terms of the DMCA, the counter notice will be given to the complaining party.

COUNTER NOTICE

  1. 1. Identification of the material that has been removed or to which access has been disabled on GoNsayn and the location at which the material appeared before it was removed or access to it was disabled:
  2. 2. I hereby state under penalty of perjury that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. 3. Your name, address, telephone number and, if available, email address:
  4. 4. I hereby state that I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located or, if my address is outside of the United States, for any judicial district in which GoNsayn may be found, and I will accept service of process from the complaining party who notified GoNsayn of the alleged infringement or an agent of such person.

User's Agreement to Hold Us Blameless/Harmless From Claims

GoNsayn has no obligation to Adjudicate IP Claims-Claimants and users must understand that GoNsayn is not an intellectual property court or tribunal. While we may in our discretion use the information provided in order to decide how to respond to infringement claims, we are not responsible for determining the merits of such claims. If a user responds to a claim of infringement by providing assurances that its content is not infringing, the user agrees that if we thereafter restore or maintain the content, the user will defend and hold GoNsayn harmless from any resulting claims of infringement brought against GoNsayn.
